STATUTE OF THE PROMOTIONAL COMPETITION
NAME OF THE PROMOTIONAL COMPETITION: "International Children's Day"
PREAMBLE
This statute of the competition "International Children's Day" (hereinafter also referred to as the "competition") is a binding document that regulates the rules of this competition and determines the conditions for its proper course (hereinafter also referred to as the "statute").
I. ORGANIZER OF THE PROMOTIONAL COMPETITION
- The announcer and organizer of the promotional competition named "International Children's Day" is the company MILK-AGRO spol. s r. o., Čapajevova 36, 080 01 Prešov (hereinafter also referred to as the "organizer").
II. CONDITIONS OF PARTICIPATION IN THE COMPETITION
Any natural person who posts a photo with our products as a comment on the published post "Competition MDD" on the official Facebook page of MILK-AGRO, spol. s r.o. may participate in the competition.
III. DURATION OF THE COMPETITION
The competition is time-limited and will take place from May 27 to June 7, 2020.
IV. RULES OF THE COMPETITION
- Anyone who posts a photo showing themselves with our products and posts the photo as a comment on the official Facebook page of MILK-AGRO spol. s r.o. becomes a contestant.
V. DETERMINATION OF WINNERS
The winners will be contestants selected by a draw from among all contestants who validly participated in the competition. The draw will take place on June 15, 2020 and 15 winners will be drawn.
VI. PRIZES

10 x winner - yogurt travel cup
VII. HANDOVER AND ACCEPTANCE OF THE PRIZE
- The method of handing over the material prize will be agreed between the organizer and the winner. Prizes not collected by the winner by July 31, 2020 will be forfeited in favor of the competition organizer.
- The winner is obliged to prove their identity to the organizer upon request for the purpose of exercising rights and/or fulfilling obligations under this competition statute. The competition organizer reserves the right to make a final decision on disputed claims of the winner to the prize or on the fulfillment of conditions under this competition statute.
- The organizer is not responsible for incorrect or incomplete data provided by the contestant. If such data are incorrect and any notification of the competition result is undeliverable to the contestant's provided contact details for any reason, the contestant's participation in the competition terminates and they lose the right to the prize.
- The prize cannot be exchanged for cash or another prize, or for other goods or services of the organizer or any third party. The prize is non-transferable. No legal claim arises for the prize in the competition; the prize cannot be enforced, even through the courts. The organizer will not reimburse any costs incurred by contestants in connection with their participation in the competition. The organizer is not liable for any damages related to non-assertion, non-acceptance, refusal, or non-use of the prize.
- Prizes in this competition are subject to tax and levy obligations under the applicable legal regulations of the Slovak Republic. The organizer is not responsible for fulfilling any tax and levy obligations of contestants or for paying any tax or levies arising from the prize according to the relevant legal regulations of the Slovak Republic.
VIII. VIOLATION OF COMPETITION CONDITIONS
- If a contestant fails to meet or violates the conditions stated in this statute, they lose the right to participate in the draw or to the prize. The organizer has the right not to hand over the prize to the winner if the winner has failed to meet or violated any provisions of this statute.
IX. PERSONAL DATA
- Based on Regulation (EU) 2019/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter "GDPR Regulation") and Act No. 18/2018 Coll. on the protection of personal data and on amendments and supplements to certain laws (hereinafter "Act"), effective from May 25, 2018, the operator MILK-AGRO spol. s r.o., with registered office at Čapajevova 36, 080 46 Prešov, Company ID: 17147786, provides you as the data subject with the following information that you need to know in connection with participation in consumer competitions it organizes. More information about the competition conditions and the rights of data subjects is available on the company's website www.milkagro.sk.
- Persons participating in the consumer competition (customers-data subjects) fill in personal data on the back of the competition receipt block, where they provide the organizer with their personal data for the purpose of organizing and subsequent evaluation of the consumer competition.
Usually, these personal data include:
name and surname, address, contact details (e.g., email or phone number). - The legal basis for processing personal data within the competitions is the consent of the data subject within the competition according to Article 6(1)(a) of the GDPR Regulation and § 13(1)(a) of Act 18/2018 Coll. on the protection of personal data. If you have given consent within the competition, you may withdraw this consent at any time with effect for the future. Details for these cases are provided on the operator's website www.milkagro.sk.
- Your personal data will be disclosed to third parties only if necessary for the realization of the competition (e.g., sending the prize via a logistics company). Disclosure of your personal data to third parties beyond this scope is strictly excluded.
- After the competition ends and the winners are announced, participants' personal data will be deleted. Winners' personal data will be stored for material prizes during the statutory warranty periods to allow repair or replacement of the item in case of defects, or for the period specified by other legal regulations imposed on the operator (organizer) of the competition.
X. PUBLICATION OF THE COMPETITION STATUTE
This competition statute will be published on the official website of MILK-AGRO, spol. s r. o.
XI. SPECIAL PROVISIONS
- The organizer reserves the right to decide on all matters concerning the competition at its own discretion and also reserves the right, in justified cases, to limit, postpone, interrupt, change, or cancel the competition and its statute at any time without compensation and unilaterally.
- The organizer reserves the right, in cases of suspicion of violation of the statute, especially in cases of fraudulent conduct contrary to good morals and obtaining prizes contrary to the competition conditions or good morals, abuse of the competition mechanism and benefits, to exclude the contestant from the competition and to refuse to provide the prize to the winner if it becomes apparent before the prize handover that the conditions for the contestant's participation or the competition conditions were not met.
- The statute takes effect on the first day of the competition.
